Levelset is a product and doing-business-as name (“DBA”) of Zermatt Business Services, LLC (“Zermatt,” “we,” “our,” or “us”).
These Terms & Conditions (“Terms”) govern your access to and use of the Levelset website, platform, and related services (collectively, the “Service”).
By accessing the website, joining the waitlist, creating an account, or using the Service, you agree to be bound by these Terms.
1. Scope of services
Levelset is a software platform designed to help organizations manage training, development, evaluations, accountability, and retention data for their teams.
The Service may include:
Administrative and leadership dashboards
Team Member accounts with role-based permissions
Data uploads and reporting related to training, evaluations, discipline, payroll-adjacent information, and retention
Early-access or limited-availability features
Levelset is provided as a tool to support organizational processes. We do not provide legal, HR, payroll, or employment advice, and use of the Service does not guarantee specific outcomes.
2. Eligibility & account access
You must be authorized by your Operator to access Levelset.
Operators are responsible for:
Defining user roles and permissions
Managing who has access to the platform
Ensuring Team Members only access information permitted by their role
Team Members may have limited visibility into their own data and restricted access to other users’ information based on organizational settings.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
3. Client & user responsibility
By using Levelset, you agree to:
Provide accurate, complete, and lawful information
Ensure you have the legal right to upload or enter any data into the platform
Use the Service in compliance with all applicable employment, privacy, and labor laws
Maintain appropriate internal policies governing employee data
Zermatt is not responsible for errors, compliance issues, or outcomes resulting from inaccurate data, improper configuration, or misuse of the Service.
4. Data ownership and use
You retain ownership of all data uploaded to or created within Levelset by your organization.
By using the Service, you grant Zermatt a limited, non-exclusive license to process, store, and display your data solely for the purpose of operating and improving the platform.
Zermatt may use aggregated and anonymized data to improve the Service, provided no individual or organization is identifiable.
5. Intellectual property
All software, platform functionality, design, documentation, and underlying technology associated with Levelset are the exclusive property of Zermatt Business Services, LLC.
You may not copy, modify, distribute, reverse engineer, or publicly display any part of the Service without prior written consent.
Nothing in these Terms transfers ownership of intellectual property to you.
6. Fees & access
Levelset may be offered under:
Early-access or pilot programs
Subscription plans
Organization-specific agreements
Pricing, billing terms, and payment obligations (if any) will be communicated separately and may be governed by additional written agreements.
Zermatt reserves the right to suspend or terminate access for non-payment or violation of these Terms.
7. Third-party services
Levelset may integrate with or rely on third-party services, including authentication providers (e.g., Google Single Sign-On) and analytics tools.
Your use of third-party services is subject to their respective terms and privacy policies.
Zermatt is not responsible for the availability, accuracy, or practices of third-party services.
8. Confidentiality
Both parties agree to maintain the confidentiality of non-public, proprietary, or sensitive information accessed through the Service.
This obligation does not apply to information that is publicly available, independently developed, or lawfully disclosed by a third party.
9. Limitation of liability
The Service is provided on an “as is” and “as available” basis.
To the maximum extent permitted by law:
Zermatt disclaims all warranties, express or implied
Zermatt shall not be liable for indirect, incidental, consequential, or special damages, including loss of data, revenue, or business opportunities
Zermatt’s total liability for any claim related to the Service shall not exceed the amount paid by you (if any) for use of the Service in the twelve (12) months preceding the claim.
10. Termination
We may suspend or terminate access to the Service at any time for:
Violation of these Terms
Security or operational concerns
Legal or regulatory requirements
Upon termination, your right to access the Service will cease. Data handling upon termination will follow our Privacy Policy and any applicable agreements.
11. Governing law
These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict-of-law principles.
Any disputes shall be resolved in a court of competent jurisdiction located in Texas.
12. Updates to these terms
We may update these Terms from time to time.
Changes take effect upon posting. Continued use of the Service constitutes acceptance of the updated Terms.
